1. About KaamDisha
Please read these Terms carefully before using KaamDisha. By using the app, you agree to these Terms.
KaamDisha is a mobile app that connects Workers (Job Seekers) with Employers looking to hire. The app also has Partner Shopkeepers and Field Agents (Internal Partners) who help grow the platform.
KaamDisha is operated by OCCD Pvt Ltd Nagpur, a company registered under Indian law. Our registered office is at T-4, Gokul Uddhav Apartment, Mangalmurti Square, Trimurti Nagar Ring Road, Nagpur, India - 440022.
2. Who Can Use KaamDisha
- You are at least 18 years old.
- You are an Indian resident or legally permitted to work in India.
- The information you provide during sign-up is true and accurate.
- You use the app only for lawful purposes.
- By signing up, you confirm that all of the above are true.
3. User Types and Their Rules
3.1 Worker / Job Seeker
Workers can browse and apply for job postings. As a Worker, you agree to:
- Provide accurate information about your skills, experience, and availability.
- Show up for jobs you accept. Repeated no-shows may result in account suspension.
- Behave professionally with Employers and other users.
- Do not share your profile or account with others.
- 3.2 Employer
- Employers can post job requirements and connect with Workers. As an Employer, you agree to post only real, accurate job requirements.
- Pay Workers fairly and on time as agreed.
- Do not post anything illegal, discriminatory, or misleading.
- Pay for job posting plans before your listing goes live.
- Do not use Worker contact information for purposes outside of hiring.
- 3.3 Partner
- Partners are local shopkeepers who help post jobs on behalf of Employers. You earn decided commission on each job posting fee paid by Employers through you.
- Payouts will be sent to your registered UPI ID once your balance reaches Rs 200 or more.
- You are an independent contractor, not an employee of KaamDisha.
- Commission rates may change with 30 days' notice.
- 3.4 Internal Partner (Field Agent)
- Field Agents onboard Partner to help grow the network. You earn specific commission of job posting revenue from Partners you onboard, for decided months from each Partner's first job posting.
- You are an independent contractor, not an employee of KaamDisha.
- You must onboard Partners in a professional and honest manner.
4. Job Posting Plans and Payments
Employers pay for job postings through the following plans:
Basic Plan: Rs 99, 7 days, up to 10 applications.
Pro Plan: Rs 199, 15 days, up to 25 applications.
Urgent Plan: Rs 299, 15 days, up to 50 applications, top placement.
All payments are processed securely through Razorpay. By making a payment, you also agree to Razorpay's Terms of Service.
All fees are non-refundable unless we are unable to activate your job posting due to a technical error on our side.
We may update our pricing with 30 days' advance notice.
5. What KaamDisha Does Not Do
KaamDisha is a platform that connects users. We are not an employer, recruitment agency, or contractor.
This means we do not guarantee jobs for Workers or Workers for Employers.
We do not verify every user's background or credentials.
We are not responsible for employment agreements between Workers and Employers.
We are not liable for disputes, accidents, losses, or damages arising from jobs arranged through the app.
We are an intermediary under Section 2(1)(w) of the Information Technology Act, 2000, and claim protection under Section 79 of the same Act.
6. Things You Must Not Do
- Posting false, fake, or misleading information.
- Harassing, threatening, or abusing any other user.
- Using the app for any illegal activity.
- Creating multiple accounts to manipulate ratings or commissions.
- Attempting to hack or disrupt the app or its servers.
- Copying or reproducing any content from the app without our permission.
- Violating these rules can lead to account suspension or permanent ban.
7. Ratings and Reviews
Employers can rate Workers after a job is completed. These ratings are visible to other Employers.
Ratings must be honest and based on actual work experience. Fake or malicious ratings are not allowed and may be removed.
8. Account Suspension and Termination
- We reserve the right to suspend or permanently close your account if you violate any of these Terms.
- We reserve the right to suspend or permanently close your account if you provide false information during registration.
- We reserve the right to suspend or permanently close your account if you engage in fraudulent activity.
- For Workers, repeated missed jobs you have accepted can lead to suspension.
- We will try to notify you before taking action, but in serious cases we may act immediately without notice.
9. Our Intellectual Property
Everything on KaamDisha, including the app name, logo, design, content, and software, belongs to us or our licensors.
You may not copy, reproduce, or use any of it without our written permission.
You are granted a limited, personal, non-transferable license to use the app for its intended purpose only.
10. Limitation of Liability
To the maximum extent permitted by Indian law, KaamDisha and its team will not be liable for any indirect or consequential losses.
This includes loss of income, data, or business opportunity, and harm caused by interactions with other users on the platform.
Our total liability to you for any claim will not exceed the amount you paid to KaamDisha in the 12 months before the claim.
11. Dispute Resolution
If you have a complaint, please first contact our Grievance Officer. We will try to resolve it within specific days.
If the dispute cannot be resolved directly, it will be settled through arbitration under the Arbitration and Conciliation Act, 1996.
The arbitration will take place in Nagpur, Maharashtra.
These Terms are governed by the laws of India.
12. Changes to These Terms
We may update these Terms from time to time.
We will notify you via the app or SMS before major changes take effect.
Continuing to use the app after changes means you accept the updated Terms.
